SUMMARY OF PROCEEDINGS OF 20th DECEMBER, 2010
16TH SESSION

The House commenced with recitation from the Holy Quran followed by Urdu translation at 10:58 A.M. and continued till 2:15 P.M. with a break of 50 minutes. Mr. Kiramatullah Khan, Speaker, Provincial Assembly was in the Chair.

2. Question Hour.

Questions relating to the following Departments were taken-up for answers:-

(a) Home & Tribal Affairs Department.

i. Question No. 822 of Mst. Noor Sahar, MPA was called but lapsed due to absence of the member.
ii. Question No. 837 of Mr. Muhammad Zamin Khan Advocate, MPA was called but lapsed due to absence of the member.
iii. Question No. 860 of Mr. Muhammad Zamin Khan Advocate, MPA was called but lapsed due to absence of the member.
iv. Question No. 861 of Mr. Muhammad Zamin Khan Advocate, MPA was called but lapsed due to absence of the member.
v. Question No. 883 of Mr. Saqib Ullah Khan Chamkani, MPA was called and referred to the Standing Committee on Home & Tribal Affairs Department with the plea that he has asked about five years break-up of financial assistance received by the Police which has not been given in the reply.

(b) Environment Department.

i. Question No. 756 of Mst. Noor Sahar, MPA was called but lapsed due to absence of the member.
ii. Question No. 857 of Mr. Muhammad Javaid Abbassi, MPA was called but lapsed due to absence of the member.
iii. Question No. 909 of Mufti Said Janan, MPA was called and replied.

(c) Revenue Department.

ii. Question No. 1058 of Mufti Said Janan, MPA was called and replied. Minister for Law assured him that instructions have already been issued to quantify the amount of hadd-i-burari,however, he assured that the issue would be resolved within a one month time.

iii. Question No. 1145 of Malik Qasim Khan Khattak, MPA was called and replied.
iv. Question No. 1166 of Mst. Noor Sahar, MPA was called but lapsed due to her absence.

(d) Health Department.

i. Question No. 930 of Mufti Said Janan, MPA was called and replied.
ii. Question No. 988 of Mr. Muhammad Javaid Abbassi, MPA was called and replied.
iii. Question No. 989 of Mr. Abdul Akbar Khan, MPA was called and replied.
iv. Question No. 990 of Mr. Abdul Akbar Khan, MPA was not put by the member; however, he showed his intention to give notice under Rule-48 for discussion on the matter raised by the said question.

· Identical Adjournment Motions No. 226 and 227 was jointly moved by Hafiz Akhtar Ali, MPA and Mufti Said Janan, MPA regarding the sacrilegious remarks of a woman named Aasia against the Holy Prophet (S.A.W). The House admitted the said motions for detail discussion under Rule-73 of the Assembly Procedure & conduct of Business Rules.

5. Calling Attention Notices.

· Calling Attention Notice No. 412 was moved by Mr. Israrullah Khan Gandapore, MPA while making statement thereon the concerned Minister assured him that he will sit with the member for resolving the matter raised by him.

· Calling Attention Notice No. 422 of Mr. Abdul Akbar Khan, MPA was moved while making statement thereon the concerned Minister stated that work would be executed within fourteen days on the roads as pointed out by the member.

6. Laying of Ordinances in the House under Article 128 of the Constitution of Islamic Republic of Pakistan.

· The Khyber Pakhtunkhwa Finance (Amendment) Ordinance, 2010(Khyber Pakhtunkhwa Ord. No. VI of 2010) was laid by the Minister for Law, Parliamentary Affairs and Human Rights.

· Disapproval resolutions under Rule 111 of the Assembly Procedure & Conduct of Business Rules read with Article 128 of the constitution on the Iqra National University Ordinance, 2010(Khyber Pakhtunkhwa Ord. No. VII of 2010) were moved by Mr. Abdul Akbar Khan and Mr. Israrullah Khan Gandapore Members Provincial Assembly. On the statement of Minister for Higher Education that improvement can be proposed in later stage of the bill but first he may be allowed to lay on the table of the House the said Ordinance, they withdrew their resolutions.

· Minister for Higher Education laid the Iqra National University Ordinance, 2010(Khyber Pakhtunkhwa Ord. No. VII of 2010) in the House.

7. Detailed discussion under Rule 73 on the Adjournment Motion No. 221 moved by Malik Qasim Khan Khattak, MPA

Malik Qasim Khan Khattak, MPA started detailed discussion on his adjournment motion regarding price hike of daily commodities distressing life of the masses. The following members also took part in the discussion:-

Mian Iftikhar Hussain, Minister for Information, Transport, Culture and Inter Provincial Coordination while winding-up discussion explained the stance and efforts of Provincial Government to curtail the menace of price hike. He iterated that one of the most viable systems which is missing in checking and controlling of prices of essential commodities is magistracy system. He informed the August House that the present regime is striving to reinstall such system in the Province. He also pointed out the recent reasons i.e. terrorism and devastations of flood which further aggravated the current situation of price hike.

Mr. Bashir Ahmad Bilour, Senior Minister for Local Government, Elections and Rural Development reiterated the establishment of magistracy system. He also informed the House that instructions have been issued to District Coordination Officers for reactivation of price review committees in the Province.

8. Point of order raised by Mr. Abdul Akbar Khan, MPA

Mr. Abdul Akbar Khan, MPA raised a point of order regarding the notification issued by the Election Commission of Pakistan renaming the constituencies of the Province from PF to PK. He stated while quoting the amended Article 213 by the Constitutional Eighteenth Amendment Act, 2010 that the Commission needs to be reconstituted and for proposing a person for the Chief Election Commission a parliamentary committee would be formed. He pleaded that since the Commission is not yet reconstituted according to the said amended Article, therefore, how such an order of the Commission is made.

The Chair sought explanation from the Law Minister and Advocate General. They requested to keep it pending for tomorrow as instantly they have not sufficient information about the matter. The Chair acceded their request.

The House was adjourned by the Chair till 10:00 A.M of Tuesday, 21st December, 2010.
